Man accused of breaking into home, forcing himself on woman found incompetent [Video]

MONROE, Ohio (WXIX) – A Monroe man accused of breaking into a home and assaulting a woman was once again found incompetent to stand trial.

In court Monday, a judge announced Achyut Dhimal was not competent to stand trial for the burglary, kidnapping, abduction, and gross sexual imposition charges he faces.

He has been found incompetent in three previous cases also.

“Mr. Dhimal is presently suffering from a severe mental illness in the form of Schizoaffective disorder bipolar type,” Judge Noah Powers explained. “It’s also his opinion that Mr. Dhimal is incapable of understanding the adversarial nature and objective of the proceedings against him.”

The National Alliance on Mental Health says the disorder can cause increased risky behavior and other symptoms of mania in a person.

Judge Powers ordered Dhimal not to be released, but instead receive treatment at Summit Behavioral Healthcare for the next year until his competency level …
